No-Fault Divorces in New York
Grounds for Divorce in New York City
Until recently, our state was the only one in the country which did not
offer the option of a no-fault
divorce. Now that it is possible, you and your spouse can more easily begin
the divorce process, but you may still face considerable challenges in resolving the issues
involved in ending a
same-sex marriage. Before initiating your divorce, contact Our firm to ensure that your
rights are fully protected. We have over 40 years of combined experience
and are led by an attorney who has earned the Super Lawyer rating, which
is based on an extensive peer review process. Our firm provides bold legal
representation on groundbreaking
LGBT issues and
same-sex family law, and we are ready to begin work on a strategy for you today.
Before our state made the option of no-fault divorce available under law,
it was necessary to file for a legal separation and live apart for at
least a year. The only alternative was to accuse the other party of being
at fault for the failure of the marriage, under grounds such as:
- Cruel and inhuman conduct
- Adultery
- Abandonment for a period of one year
The new law makes it possible to file for divorce on the grounds that the
marriage has been irretrievably broken for 6 months or more.
Ending Your Marriage through No-Fault Divorce
The availability of no-fault divorce makes it simpler to initiate the process,
but it does not mean that ending your marriage will be easy. The judge
will not finalize your divorce until you have come to agreements with
your spouse on matters such as
child custody,
child support and the division of property. If you cannot resolve these issues out of
court, the judge will make rulings on each point for you, so it is advisable
to retain a dynamic New York City divorce lawyer who will look out for
your best interests and fight for a favorable outcome. We will strive
to achieve an out of court settlement, but we prepare every case for trial,
as this is sometimes necessary to get the best results. Our goal is to
help you find a way through this difficult experience with a minimum of
delay and expense.
